Disability Law

What is Disability Law?

Disability Law (and Disability Attorneys) is the area of law that deals with the denial of insurance benefits to people who become disabled and are no longer able to work.

As disability attorneys, we represent claimants (never insurance companies or the government) who are permanently disabled in order to get them the disability benefits that have been denied and that they deserve.

At Law Med, we focus exclusively on two types of long-term disability (LTD) benefits; (1) Social Security Disability (SSDI) and (2) Employer-Provided Disability Plans (ERISA). That's all we do.

Employer-Provided Disability Plans (ERISA)

An employer may provide a long-term disability group plan to its employees at the time of hire as a fringe benefit. Such a plan would typically be governed under a federal law called the Employee Retirement Income Security Act (ERISA). As knowledgeable attorneys know, this is a very complicated area of the law, with strict deadlines, complex regulations, and minefields for the unwary. In other words, it's best to leave ERISA law to experienced and qualified ERISA attorneys.

If you have an  LTD claim through your employer that has been denied, overturning an ERISA denial can be very complicated. At Law Med, we can help. That's what we do.

Social Security Disability Insurance (SSDI)

SSDI cases are also fraught with complex rules, strict deadlines, and complicated medical and legal issues.

At Law Med, we take both long-term disability cases under Social Security and ERISA, because they frequently arise out of the same disability and often come to our office together. In other words, if you have an SSDI claim and also work for an employer who provides a disability plan, you can have two simultaneous disability claims.

It makes sense to handle them together. We can do that at Law Med.
